Welcome to Cogito. The Cogito application, software, and related services (collectively, the "Services") are provided by Ouaknine Thiriet + Partners, a company registered in Paris ("Licensor"). By accessing or using the Services, you agree to these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein. If you do not agree, you are not permitted to use the Services.

1. User Account

To access certain features, you may need to create an account. Your account information should be accurate and updated regularly. You are responsible for maintaining the confidentiality of your password and for any activity under your account. Notify us at support@cogito-app.com if you suspect unauthorized access to your account.

You agree not to use another user's account or disclose your password to any third party. We may allow registration and login through third-party platforms (e.g., Apple, Google). By using these features, you also agree to comply with the third-party platform's terms of service.

2. Eligibility and Age Requirements

You must be at least 13 years old or meet the minimum age requirement in your jurisdiction to use the Services. If you are under the age of majority in your jurisdiction, you must have the express consent of a parent or legal guardian. By using the Services, you affirm that you meet these age requirements. We reserve the right to request proof of age or consent and to suspend accounts that violate this requirement.

3. Proprietary Rights

All materials in the Services, including but not limited to design, text, logos, code, and intellectual property rights, belong to Cogito or its partners. Unauthorized use, reproduction, modification, distribution, or sale of this content is prohibited. Cogito reserves all rights not expressly granted to you.

4. License to Use

The Services are licensed, not sold, to you. Subject to your compliance with these Terms, Licensor grants you a limited, non-exclusive, non-transferable license to use the Services on any Apple-branded products that you own or control, as permitted by Apple's Usage Rules and these Terms.

If you sell or transfer your Apple device to a third party, you must remove the Services from the device beforehand.

5. User Content

By submitting content such as questions, exercises, messages, or images through the Services, you grant Cogito a worldwide, royalty-free, irrevocable, fully sublicensable, and transferable license to use, modify, display, and distribute such content for the purpose of providing and improving the Services. You represent that you have the rights to any content provided and that it does not infringe on any third-party rights.

You waive any moral rights in your submitted content to the fullest extent permitted by law. Cogito reserves the right to remove any content that violates these Terms or applicable laws.

6. Usage Rules

You agree to use the Services for lawful purposes and comply with the following usage rules:

7. Premium Services and Payment

Cogito may offer Premium Services for a fee. By purchasing a subscription, you agree to the displayed pricing and payment terms. Subscriptions automatically renew unless canceled before the end of the current term. Refunds are subject to the policies of the platform through which the purchase was made.

If you are a resident of the European Economic Area (EEA) or the UK, you have the right to withdraw from your subscription within 14 days of purchase. Contact support@cogito-app.com to exercise this right.

8. AI Disclaimer

Cogito uses AI models to provide educational assistance. While efforts are made to ensure accuracy, AI-generated content may contain errors. The information provided should be used as a study aid and not as a definitive source. Use of such content is at your own risk, and Cogito is not liable for any inaccuracies or decisions made based on the information provided.

9. Modifications and Termination

Cogito reserves the right to modify or discontinue the Services at any time. Continued use after changes constitutes acceptance of the updated Terms. We will provide reasonable advance notice of material changes. These Terms remain in effect until terminated by you or Cogito.

10. Limitation of Liability

To the extent permitted by law, Cogito disclaims liability for any damages arising from use or inability to use the Services, including but not limited to loss of data or profits. Cogito's total liability shall not exceed fifty dollars ($50.00). These limitations apply even if a remedy fails of its essential purpose.

11. Third-Party Services and Integrations

The Services may include integrations with third-party platforms. Cogito is not responsible for the performance or content of third-party services. Use of such services is at your own risk and subject to the third-party's terms.

12. Content Moderation

Cogito monitors content to prevent harmful or illegal material. Automated systems and human moderators may review content. We reserve the right to remove content that violates these Terms or applicable laws. Users may report inappropriate content via support@cogito-app.com.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris unless local laws provide otherwise for users in the EEA.
